Relator, Cleveland City School District Board of Education, has filed a complaint for a writ of prohibition to prevent the respondent, Judge Thomas J. Pokorny, from exercising judicial power in a civil action that is presently pending within the Cuyahoga County Court of Common Pleas.
On or about May 16, 1988, Nellie Taylor was assaulted by a student while in the employ of the relator. On October 8, 1991, Taylor was awarded assault leave benefits after a grievance was sustained by the Superintendent of Schools. In the fall of 1993, the relator suspended Taylor’s assault leave…
