The defendants, an attorney and his wife, who will hereinafter be referred to in the singular, purchased an automobile from Cushing - Motor Company, pursuant to certain written instruments which they had signed. One of the instruments was a conditional sale contract. Said contract was assigned by the motor company to the plaintiff, Universal Credit Company. A default ensued, and plaintiff instituted this action in replevin for recovery of the automobile.
