1Opinion of the CourtJustice Boggs

The appellant brought an action in assumpsit against the appellee to recover the sum of $300. The case was submitted to the court without the intervention of a jury, upon a stipulated state of facts. The issues were found against the appellant, and judgment for costs was entered against him. The Appellate Court for the Second District affirmed the judgment on appeal but granted a certificate of importance, and this appeal has been perfected to reverse the judgment of affirmance., It is necessary to the proper disposition of the question of law that arises that the facts of the case be stated.
