*1158In May 1999, Randy M. (hereinafter respondent) was convicted in Supreme Court (Firetog, J.) in Kings County upon his plea of guilty to one count each of sexual abuse in the first degree and endangering the welfare of a child. The court imposed concurrent sentences of five years and one year in prison, respectively. Because the court did not impose the mandatory period of five years of postrelease supervision (see Penal Law former § 70.45 [2]), the Department of Correctional Services (hereinafter DOCS) imposed such supervision upon respondent’s release from prison on March 20, 2003.1 In August…
