van Roden, P. J.,

— Decedent died January 21, 1909, survived by his widow but by no issue. By his duly probated will he devised and bequeathed his entire residuary estate in trust for the benefit of his wife for life, and then disposed of the remainder in the following language:

“and after the death of my beloved wife, I give, devise and bequeath the sum of Five thousand dollars ($5000.) of said residuum to the Board of Ministerial Relief of the United Presbyterian Church of the United States absolutely, and the balance or remainder of said residuum after payment of said legacy of Five Thousand…
