LESTER, Judge.
This is an appeal from a judgment entered pursuant to a jury verdict determining that a coal lease between the parties was null and void by virtue of alteration.
The appellees filed their complaint on February 13, 1976, to which answer was filed by appellants on March 3, 1976. On July 14, 1976, appellants took the depositions of Cíete Ferguson and Boone Sloas with counsel for appellees present, but neither of appellees were in attendance.
