delivered the opinion of the court.:

This is an appeal from a decision of the Commissioner of Patents in a trade-mark interference proceeding in which the question is-priority of adoption and use of the words “ Liquid Solder ” as a. *985trade-mark for a radiator sealing compound, appellant having registered such mark in May, 1925, -upon’ an application filed in December, 1923, and appellee having on January 4, 1926, filed an application for registration of the words “ Cy’s Liquid Solder.”
