On March 10, 2011, the Trustees of the United Mine Workers of America 1974 Pension Trust (“Trustees” or “plaintiffs”), brought this suit under the Employee Retirement Income Security Act, 29 U.S.C. § 1001 et seq. (“ERISA”), and the Labor Management Relations Act, 29 U.S.C. § 141 et seq. (“LMRA”), seeking “delinquent contributions due and owing” to the United Mine Workers of America 1974 Pension Trust (“Trust”) from defendant ACL Transportation Services, LLC (“ACLTS” or “defendant”).
