MEMORANDUM OF OPINION AND ORDER

The above-styled proceeding was filed by Klaus Hubert Goerg [hereinafter referred to as “Petitioner”], the bankruptcy trustee of the estate of Heinz Guenter Kaussen appointed under the Laws of the Federal Republic of Germany, petitioning this Court for ancillary administration pursuant to 11 U.S.C. § 304. It is before the Court on a Motion to Dismiss filed by Edgardo L.
