TJOFLAT, Circuit Judge:
This appeal presents a question of first impression for this court: whether section 304 of the Bankruptcy Code, 11 U.S.C. §§ 101-133.0, opens United States bankruptcy courts to proceedings ancillary to foreign insolvency proceedings where the entity that is the subject of the foreign proceeding qualifies for insolvency administration under foreign law, but does not fall within the Bankruptcy Code’s definition of “debtor.” Both the bankruptcy court and the district court in this case answered the question in the negative, holding that a West German bankruptcy trustee was…
