BOWMAN, Circuit Judge.
On September 3, 2003, a jury convicted Appellant Elijah Hayes on two counts: conspiracy to distribute and possess with intent to distribute crack cocaine, and possession with intent to distribute crack cocaine. Hayes appeals his conviction on both counts. The government cross-appeals, claiming the District Court erred by granting Hayes a sentencing reduction for being a minor participant in the charged offenses.
