Smith and others presented their petition to the board of commissioners of Tipton county, for the laying out of a county road, passing through the lands of Kemp. Viewers were appointed, who reported in favor of the highway; whereupon Kemp presented the remonstrance of himself and others, alleging that the road would not be of public utility. Reviewers were appointed, pursuant to the statute, who reported that the road would be of public utility. Kemp then made his claim for damages, in consequence of the highway being located through his land; assessors were appointed, who reported that he…
