The defendant was indicted for the unlawful possession and sale of alcoholic liquor and malt beverages. She waived a jury trial and was found guilty by the court. There was no allegation of previous conviction either in the information or indictment. Upon the district attorney furnishing to the court the fact that she had been previously convicted of the same offense, she was sentenced, on September 20, 1944, to pay a fine of '$200 and be imprisoned in the jail for a period of two months.
