OPINION ANNOUNCING THE JUDGMENT OF THE COURT
HUTCHINSON, Justice.
Appellant, the Commonwealth’s Department of Aging, filed a notice of appeal from Commonwealth Court’s December 20, 1982 order directing it to reinstate appellee to the position from which the Civil Service Commission had held he was improperly furloughed. Commonwealth Court had previously affirmed that decision on the Department’s *426Petition for Review. While appellee’s action was pending the Department offered him a lesser position.
