City Magistrate. The complainant, Mary Kay, charges the defendant, Constantine Kay, with being a disorderly person by reason of his abandonment of and his failure adequately to support her. The defendant denies that he is a disorderly person by virtue of his failure to support complainant because he alleges that he is not her husband. The complaint is brought under section 899, subdivision 1, of the Code of Criminal Procedure, which reads as follows: “ The following are disorderly persons: 1.
