OPINION and JUDGMENT

DALTON, District Judge.

This cause comes before the court upon a petition for habeas corpus, filed in forma pauperis by a State prisoner pursuant to the provisions of 28 U.S.C. § 2254 (1959).

At the March 1964 term of the Ala-mance County, North Carolina, Superior Criminal Court Hubert Creighton,- the petitioner, was convicted of “Unlawfully Entering a Building Without Intent to Commit a Felony” and was sentenced to a period of incarceration of two years.
