Action in the district court for Jackson county to recover $1,000 ‘for'malicious prosecution. The case was tried before Lorin Cray, J., and a jury, which rendered a verdict in favor of plaintiff for $250. From an order denying a motion for judgment notwithstanding the verdict or for a new trial, defendant appealed.

Action for malicious prosecution, in which plaintiff had a verdict, ;and defendant appealed from an order denying a new trial.

It appears from the record that this was the second trial of the action, the verdict rendered on the first trial having been set aside and a new trial granted. At the opening of the former trial, counsel for defendant moved the court that plaintiff be required to elect whether "he would proceed with the case as an action for malicious prosecution .or for false imprisonment.
