This is an action against the United States of America under the Federal Tort Claims Act, 28 U.S.C. § 1346(b)(1) (“FTCA”), seeking damages, for personal injuries and wrongful death, caused by a federal pre-trial releasee, David Renz (“Renz”), who, after being charged with receiving and possessing child pornogra*465phy, was released from custody under the supervision of U.S. Probation and Pretrial Services Office for the Northern District of New York (“Probation”), in Syracuse, New York.
