ERICKSEN, District Judge.
This is an action by Joetta Drake, as legal guardian for Adrian V. Cotton, an incapacitated person, and the Minnesota Department of Human Services (collectively, Plaintiffs) against several individuals 1 in their individual and official capacities and against McLeod County (County) after Cotton attempted to commit suicide while he was an inmate in McLeod County jail. Plaintiffs assert claims under 42 U.S.C. § 1983 (2000) for violations of the Eighth and Fourteenth Amendments and under Minnesota law for negligence. The matter is before the Court on the Individual…
