On the thirtieth day of October, 1882, as "Phillip A. Mynning was crossing a spur track of the defend*95■ant, he was run over by a train of cars and killed. The accident occurred while he was walking along one of the public streets in the city of Big Rapids, between six and seven o’clock in the evening. At this time it was quite dark. A rain-storm was approaching, with considerable wind from the south-west. The deceased was walking rapidly east, and the train was backing from the north.

This action is brought by the administrator of deceased to recover damages for the wrongful and negligent…
