MINER, Circuit Judge:

Petitioner-appellant Wendell Elcock appeals from an order entered on November 24, 1993 in the United States District Court for the Eastern District of New York (Nick-erson, /.), dismissing his petition, brought pursuant to 28 U.S.C. § 2254, for a writ of habeas corpus, the district court having found that Elcock was afforded effective representation on his belated state court appeal.
