DALTON, Presiding Judge.
Defendant has appealed from a conviction and a sentence of ten years for burglary and three years for stealing, the sentences to run concurrently, and for which sentences he was committed to the Department of Corrections of the State of Missouri. Prosecution was under the Habitual Criminal Act, since it was alleged and shown that on October 14, 1946, defend had been convicted of murder in the first degree in the Circuit Court of the City of St. Louis, and had been sentenced to imprisonment in the state penitentiary for the term of his natural life.
