I. INTRODUCTION

On January 6, 2005, oral argument before the undersigned United States District Judge was heard on the cross-motions for Summary Judgment [Docket Nos. 20 and 31] of Plaintiff Odens Family Properties, LLC (“Plaintiff’) and Defendants Twin Cities Stores, Inc., and Twin Cities Stores, Inc., (“TCS” or “Defendants”). Plaintiffs Complaint [Docket No. 1] alleges Defendants are the guarantor of a number of commercial leases that are in default. Defendants have refused to honor the guaranties.
