PELPHREY, Chief Justice.

On July 10, 1930, appellant issued a health and accident insurance policy insuring William T. Cardwell, among other things, against loss of life. Among others, the policy contained a provision that, in the event of the loss of life through accidental means, after fifteen days from the date of the policy and within ninety days from the date of accident, appellant would pay to appellee, the brother of William T.
