Plaintiff International Association Of Heat And Frost Insulators And Asbestos Workers Local Union No. 42 (“Local 42” or “plaintiff”) and defendants Absolute Environmental Services, Inc. (“AESI”) and Joseph G. Donohoe have filed cross motions for summary judgment pursuant to Rule 56 of the Federal Rules of Civil Procedure.
