A careful review of both the pleadings and the evidence submitted in connection with the motion for summary judgment impels me to dissent—not because of *443any disagreement with, the philosophy of the able opinion of the majority, but because I find cases in the reports of both this court and the Supreme Court which demand a different result. I have called these cases to the attention of the court, urging that they should be frankly met and dealt with.
