We consider the appeal of Banacol Marketing Corporation (Banacol) from the orders of the Court of Common Pleas of Philadelphia County (trial court) that sustained the preliminary objections of Penn Warehousing & Distribution (PWD) and the Philadelphia Regional Port Authority (PRPA) to Banacol’s complaint alleging breach of contract, dangerous condition of real property, and misrepresentation, and which overruled PRPA’s preliminary objection to jurisdiction.
