This matter comes before the Court on Plaintiffs Motion for Partial Summary Judgment on Counts I and II of his Complaint and Defendant’s Motion for Summary Judgment. For the reasons expressed below, Plaintiffs Motion will be denied, while Defendant’s Motion will be granted in part and denied in part.

I. BACKGROUND
