This case presents, an appeal by the state 1 from an order of the Polk County District Court suppressing certain evidence prior to trial. We affirm in part and reverse in part.

On December 27, 1973, the defendant was called at home and invited down to the police station to answer some questions in regard to a homicide investigation. Bruce Slager, a friend of the defendant, had shot and killed his mother on December 22, 1973.
