OPINION ON GOVERNMENT’S MOTION FOR A PROTECTIVE ORDER AND TO QUASH SUBPOENAS

BROTMAN, District Judge (sitting by designation).

This matter comes before the Court on the Government’s motion to quash subpoenas to compel the testimony of four federal court judges at an evidentiary hearing to recuse Judge Moore from presiding over this criminal case. The Government also seeks a protective order to prevent the service of further subpoenas seeking similar information. It is Defendant’s contention that the judges’ testimony is necessary to create a factual record in support of his Motion to Recuse.…
