The Grant 'ooiunty Board of Control and the Bnrley Tobacco Society filed suit in toe Fayette circuit court against A. 'S. Allphin, in which- they sought to' enjoin him *281from ¡selling, or otherwise disposing of, a crop of tobacco raised by 'him in 1909 and which, it is alleged in the petition, he had pooled. The petition set out the fact of the organization of the Burley Tobacco Society and of the Grant county Board of Control, a branch thereof; that the business of 'the society was the pooling of tobacco grown in the hurley district in order to…
