SARGUS, District Judge.

Plaintiff Mary Kelly [‘‘plaintiff’], the mother and administratrix of the estate of Ernest Davis [“decedent”], who was incarcerated at the Ross Correctional Institution [“RCI”] from November 1992 to June 1993, brings this civil rights action under 42 U.S.C. §§ 1983 and 1988, alleging that defendants were deliberately indifferent to decedent’s serious medical needs.
