(After stating the foregoing facts.)
1. While the evidence introduced by the plaintiff to establish, the alleged fact of negligence upon the part of the defendant, company, as alleged in the petition in this case, is weak and in many respects unsatisfactory, it can not be said that, taking into-consideration all the evidence and the deductions which the jury were authorized to make therefrom, the trial judge erred in the • exercise of his discretion, when he refused to grant a new trial, on the ground that the verdict was contrary to the evidence and. without evidence to support it.
