The complainant, A. T. Gilley, appeals to this court from the decree of the court of chancery appeals dismissing his hill. The original bill in the case was filed in the chancery court at Murfreesboro to collect a note for three hundred dollars alleged to have been executed by the defendant J. R. Harrell to one Robert B. Meeks, and by Meeks transferred and assigned to the complainant, *118and seeking to foreclose a mortgage or deed of trust given to secure the payment of the note and to set aside a previously executed trust deed…
