This case is before the court on a Writ of Certiorari to the Court of Civil Appeals, 53 Ala.App. 1, 296 So.2d 896. The petition for the Writ of Certiorari was granted to review what apparently is a question *528of first impression in this state — the construction to be given an up-rated policy of insurance.
