McCULLOUGH April 10, 2025 COMMONWEALTH OF VIRGINIA FROM THE COURT OF APPEALS OF VIRGINIA Allen Poulson, who was ultimately convicted of driving under the influence, challenges several aspects of his questioning and arrest on Fourth and Fifth Amendment grounds. Specifically, he argues that he was in custody and, therefore, he should have been given Miranda warnings.
