MEMORANDUM OPINION

BIGGERS, District Judge.

This cause comes before the court upon the defendants’ motion for summary judgment. 1 The court has duly considered the parties’ memoranda and exhibits and is ready to rule.

FACTS

This case arises out of a collision in Walls, Mississippi, on May 28, 1996, between plaintiff’s pick-up truck and an Amtrak passenger train being operated on Illinois Central tracks. The collision occurred during daylight hours at approximately 7:30 a.m. The tracks and the crossing were elevated so that the plaintiff had to drive up and over a slight rise to cross the tracks.…
