MEMORANDUM AND ORDER

JOYNER, District Judge.

This case has been brought before the Court on motion of the defendants for summary judgment. For the reasons which follow, the motion shall be granted in part and denied in part.

Statement of Facts

On January 3, 1997, the plaintiff, Barry Walker, was observed via closed circuit television in the Strawbridge’s department store in Center City Philadelphia by defendant Kim Stone, a store detective.
