MEMORANDUM OPINION

ROBERT M. HILL, District Judge.

This cause came on for trial before the Court, and having heard the evidence and argument of counsel the Court makes the following findings of fact and conclusions of law.

On February 9, 1978, the City of Wichita Falls (“City”) indefinitely suspended plaintiff Duward Stone (“Stone”) from his position as a fireman because he violated Section 31(B) of City Civil Service Rule 14 1 and Section 136 of the City Charter (“Sec tion 136”) 2 by becoming a candidate for County Commissioner in nearby Archer County.
