This was a writ of error to the Court of Common Pleas of Bed-ford county, in an ejectment brought by George Lucas, and others, plaintiffs below, against Griffith Mickle, and John Mickle, defendants below, which a verdict and judgment were rendered in favour of the plaintiffs below. The plaintiffs below claimed under an improvement commenced by George Dobson, about the month of April, 1763. In consequence of the Indian war, Dobson left his land in the year 1764, and with his family took refuge in Bedford. (after stating the case.) Several errors have been assigned in the opinion of the Court of Common Pleas.

1. “That inasmuch as Campbell’s warrant called for an improvement, without saying when it was made, the title under that *294warrant could not be carried back farther than its date.” This opinion was in exact conformity to the rule laid down by this court.
