RIVES, Circuit Judge:
Alice Durlene Nall, 1 Robert Hise Sportsman, Mahlon E. Faust, and Joseph Cecil Frazier 2 were indicted in two counts. The second count charged them with the unlawful transportation in interstate commerce of stolen securities, that is, approximately 900,000 shares of stock in North American Cigarette Manufacturer’s, Inc., of the value of more than $5,000 in violation of 18 U.S.C. § 2314. 3 The first count charged them with conspiracy in violation of 18 U.S.C. § 371 4 to commit the substantive offense charged in the second count.
