Plaintiff brought this action in claim and delivery in a justice’s court to recover the possession of twelve head of cattle or their value. Judgment was there recovered in favor of plaintiff. The ease was appealed to the district court with a like result. Motion for new trial was made, heard and denied. Defendants have appealed to this court from the judgment of the district court.
