Plaintiffs, husband and wife, are riparian owners of land on Wilson Creek near the City of Springfield. They have sued for the damage to their land- caused by the city in gathering together and emptying sewage into the creek, thereby polluting the water and creating smells. The petition was filed in the Circuit Court of Greene County on the 6th of March, 1934. On change of venue, the casé was tried in the- Circuit Court of Laclede County, and resulted in a judgment of $1500 for the plaintiffs. The Springfield Court of Appeals affirmed the judgment.
