Respondents sue to recover damages for the alleged breach of a contract to sell and deliver ■sixty shares of the stock of the Pacific Coast Biscuit Company. The complaint alleged a contract consisting of telegrams exchanged between the parties, and the execution of the contract was admitted by the answer of appellant.

Appellant filed an affirmative answer alleging the following facts:

“That plaintiffs at all the times herein mentioned and for a considerable time theretofore maintained offices in the Hoge Building in Seattle, Washington and held themselves out as legitimate stock brokers,…
