This is the second appeal of this case. The first heaiúng on appeal is reported in 27 S.W. (2d) 363, to which we refer for a full discussion of several propositions presented on this trial.

The suit arises under the Texas Workmen’s Compensation Law. At the time of the mat ters involved in this suit Dewey Adcock was an employee of Oldham & Sumner Lumber Company, which company carried a policy of workmen’s compensation insurance with appellant, Texas Employers’ Insurance Association.
