The respondent, a surety company, as surety, and the First National Bank of Harrison, Nebraska, a designated depository for county funds, as principal, gave their bond to Sioux County, Nebraska, the petitioner, in the sum of $30,000. The bond,* required by statute, was conditioned on the payment by the bank, on the order of the county treasurer, of all sums of money deposited with it by the county.
