Beversing.

Appellees, Garth and others, instituted in the Scott County Court a proceeding seeking the alteration of. a portion of the county road known as the Lemon’s Mill Pike, the change sought to be made being the closing of a portion of the road so as to abolish a grade crossing over the track of the C. N. 0. & T. P. Bailroad, and the opening of a new road in lieu of the portion discontinued, at a point where the crossing over the railroad track could be made by an overhead bridge.
