PARKER, Justice.

Defendant was tried capitally on a multi-count indictment charging him with first-degree murder, assault with a deadly weapon with intent to kill inflicting serious injury, attempted robbery with a dangerous weapon, and conspiracy to commit robbery with a dangerous weapon. At the close of the evidence, the trial court quashed the count alleging attempted robbery with a dangerous weapon.
