Defendant insurer has appealed from a judgment in an action for declaratory relief which determined that its policy furnished uninsured motorist coverage as defined in section 11580.2 of the Insurance Code of this state, and that plaintiff as a passenger on the named insured’s vehicle was entitled to the benefits of that insurance. A form of waiver was signed by the insured that purported to be in accordance with the provisions of section 11580.2, subdivision (a) of the California Insurance Code which permits the insured and the company to so agree.
