A jury in Sedgwick County convicted Ricky Jacques of having unlawful possession of heroin. The conviction was affirmed by the Court of Appeals. State v. Jacques, 2 Kan. App. 2d 277, 579 P.2d 146 (1978). This court granted review in order to consider three questions presented.

The first question of concern to this court was raised by the following point of argument contained in appellant’s Petition for Review:
